These Terms and Conditions apply to your use of PodFinder, including our website, mobile app, conversational podcast discovery tools, podcast recommendation features, account features, content, software and related services.
PodFinder is owned and operated by Lawson Media Pty Ltd ABN 17 627 544 950.
In these Terms, “PodFinder”, “we”, “us” or “our” means Lawson Media Pty Ltd. “You” or “your” means the person accessing or using PodFinder.
By accessing or using PodFinder, you agree to these Terms. If you do not agree, you must not use PodFinder.
1. About PodFinder
PodFinder helps people discover podcasts.
PodFinder may allow you to:
- search for podcasts;
- browse podcast information;
- receive podcast recommendations;
- use conversational or AI-powered podcast discovery tools;
- save, follow, rate, hide or organise podcasts;
- create an account;
- receive personalised recommendations based on your activity, preferences or listening habits;
- access related features we make available from time to time.
PodFinder does not usually host or produce the third-party podcasts listed or recommended through the service. Podcast content, descriptions, artwork, episode titles, feeds, metadata and availability may be supplied by podcast creators, platforms, directories, RSS feeds, data providers or other third parties.
2. Eligibility
You must be at least 13 years old to use PodFinder.
If you are under 18, you must have permission from a parent or guardian to use PodFinder.
By using PodFinder, you represent that you have the legal capacity to agree to these Terms.
3. Accounts
Some features may require you to create an account.
You agree to provide accurate, current and complete information when creating or updating your account.
You are responsible for:
- keeping your login details secure;
- all activity that occurs under your account;
- notifying us promptly if you suspect unauthorised access or misuse.
We may suspend or terminate your account if we reasonably believe that you have breached these Terms, created risk for PodFinder or other users, or used the service unlawfully.
4. Your use of PodFinder
You must use PodFinder lawfully and responsibly.
You must not:
- use PodFinder for unlawful, harmful, misleading, abusive or fraudulent purposes;
- interfere with or disrupt PodFinder’s systems, security or availability;
- scrape, crawl, harvest or extract data from PodFinder without our written permission, except where permitted by law;
- reverse engineer, decompile or attempt to discover source code or underlying systems, except where permitted by law;
- submit malicious code, spam, automated requests or excessive traffic;
- impersonate another person or misrepresent your identity or affiliation;
- infringe intellectual property, privacy or other rights;
- use PodFinder to build a competing service without our written permission;
- attempt to manipulate recommendations, ratings, rankings or search results;
- use PodFinder in a way that breaches these Terms or any applicable law.
5. Conversational and AI-powered features
PodFinder may include conversational, AI-powered or automated recommendation features.
You acknowledge that these features may:
- generate imperfect, incomplete, outdated or inaccurate responses;
- misunderstand your request;
- recommend podcasts that are not suitable for you;
- reflect limitations in available podcast data;
- produce different results for similar searches.
You should use your own judgement before relying on any recommendation, summary or response.
You must not use conversational features to submit unlawful, harmful, confidential, highly sensitive or third-party personal information unless you have the right to do so and are comfortable with it being processed to provide the service.
We may monitor, store, review or process prompts, queries and outputs in accordance with our Privacy Policy to operate, improve and protect PodFinder.
6. Podcast information and third-party content
PodFinder may display podcast names, descriptions, artwork, categories, episode information, links, ratings, reviews, rankings, transcripts, summaries or other metadata.
This information may come from third parties and may change without notice.
We do not guarantee that:
- podcast information is accurate, complete or current;
- podcast links or feeds will always work;
- a podcast will remain available;
- recommendations will match your preferences;
- third-party content is suitable, lawful or non-infringing;
- rankings, ratings or categories are objective or comprehensive.
Third-party podcasts and websites are controlled by their respective owners. We are not responsible for third-party content, platforms, websites, apps, feeds, advertising, sponsorships, purchases, subscriptions or privacy practices.
7. Recommendations are not endorsements
A podcast appearing on PodFinder does not mean we endorse it.
Recommendations, rankings, lists, summaries and conversational responses are provided for discovery and informational purposes only.
Some recommendations, rankings or placements may be sponsored, promoted, paid for or influenced by commercial relationships if we introduce those features in the future. Where that happens, we will take reasonable steps to identify sponsored or promoted content clearly.
Podcasts may contain views, claims, advertising, sponsorships, medical information, financial information, legal information, political views, explicit content or other material that you may find inaccurate, offensive or unsuitable.
You are responsible for deciding what to listen to and whether any content is appropriate for you.
8. Sponsored recommendations and commercial relationships
PodFinder does not currently include sponsored podcast recommendations at launch.
In the future, PodFinder may include sponsored recommendations, paid placements, affiliate links, advertising, promotional content or other commercial arrangements.
Where we include sponsored recommendations, paid promotional placements or similar commercial content, we will take reasonable steps to identify them clearly, such as by using labels like “Sponsored”, “Promoted”, “Advertisement” or similar wording.
Sponsored recommendations may be influenced by a commercial relationship, but we will aim to ensure they remain relevant to podcast discovery and do not prevent you from accessing non-sponsored podcast results or recommendations.
A sponsored recommendation does not mean that we guarantee, endorse or are responsible for the podcast, creator, advertiser, sponsor, product, service, claim or third-party content associated with that recommendation.
9. User content and feedback
PodFinder may allow you to submit content, such as ratings, reviews, comments, prompts, lists, preferences, profile information, feedback or other material.
You retain ownership of content you submit, but you grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, host, store, reproduce, modify, adapt, publish, display, distribute and otherwise process that content for the purpose of operating, improving, promoting and protecting PodFinder.
You represent and warrant that:
- you have the rights needed to submit the content;
- your content does not infringe any third-party rights;
- your content is not unlawful, defamatory, misleading, abusive, obscene or otherwise harmful.
We may remove or restrict access to user content at our discretion, including where we believe it breaches these Terms or creates risk for PodFinder or others.
If you provide ideas, suggestions or feedback, we may use them without restriction or compensation to you.
10. Intellectual property
PodFinder, including its software, design, branding, logos, text, graphics, interfaces, features, databases, recommendation systems and other materials, is owned by or licensed to Lawson Media Pty Ltd.
Except as expressly allowed by these Terms, you must not copy, reproduce, modify, distribute, sell, license, exploit or create derivative works from PodFinder or its content without our written permission.
You may use PodFinder for your own personal or internal business purposes in accordance with these Terms.
All third-party podcast names, artwork, trademarks, feeds and content remain the property of their respective owners.
11. Copyright and takedown requests
If you believe content available through PodFinder infringes your copyright or other rights, please contact us with:
- your name and contact details;
- details of the content in question;
- the rights you claim are infringed;
- the URL or location of the content on PodFinder;
- a statement explaining why you believe the use is unauthorised;
- any supporting information.
We may remove, disable or restrict access to content where we consider it appropriate.

12. Privacy
Our handling of personal information is described in our Privacy Policy.
By using PodFinder, you acknowledge that we may collect, use, store and disclose information as described in that Privacy Policy.
13. Paid features and subscriptions
PodFinder may offer paid features, subscriptions, premium accounts, trials, paid recommendations, API access or other paid services in the future.
If we introduce paid features, additional payment terms may apply, including terms about:
- prices;
- billing cycles;
- renewals;
- cancellations;
- refunds;
- trials;
- taxes;
- app store payment terms;
- changes to paid features.
We will make those terms available before or at the time you purchase the relevant paid feature.
Nothing in these Terms limits rights you may have under the Australian Consumer Law or other applicable consumer protection laws. Under the Australian Consumer Law, businesses must meet consumer guarantees when supplying products or services, and consumers may be entitled to remedies where those guarantees are not met.
14. Beta, experimental and free features
Some PodFinder features may be provided as beta, trial, experimental, preview or free features.
These features may be changed, limited, suspended or discontinued at any time.
Beta or experimental features may be less reliable and may contain errors, interruptions or incomplete functionality.
15. Availability and changes to PodFinder
We may modify, suspend or discontinue any part of PodFinder at any time, including features, recommendations, accounts, integrations, data sources or availability.
We do not guarantee that PodFinder will always be available, uninterrupted, secure or error-free.
We may need to perform maintenance, updates or emergency fixes from time to time.
16. Disclaimers
To the maximum extent permitted by law, PodFinder is provided on an “as is” and “as available” basis.
We do not make any guarantees, representations or warranties that:
- PodFinder will meet your expectations;
- recommendations will be accurate or suitable;
- podcast information will be complete, current or reliable;
- PodFinder will be uninterrupted, secure or error-free;
- defects will be corrected;
- PodFinder will be free from viruses or harmful components;
- third-party podcasts or links will be available or safe.
This section does not exclude, restrict or modify any rights you have under the Australian Consumer Law or other laws that cannot be excluded, restricted or modified.
17. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable law that cannot lawfully be excluded, restricted or modified.
Where we are permitted to limit our liability for breach of a consumer guarantee or other statutory guarantee, our liability is limited, at our option, to:
- supplying the services again; or
- paying the cost of having the services supplied again.
This limitation does not apply where it would be unlawful or unfair to do so.
Consumer guarantees are automatic rights and cannot be negotiated away.
18. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss or damage, including loss of profits, revenue, data, goodwill, opportunity, reputation or business interruption.
To the maximum extent permitted by law, our total aggregate liability to you for claims arising out of or in connection with PodFinder or these Terms is limited to:
- the amount you paid us for PodFinder in the 12 months before the claim arose; or
- AUD $100,
whichever is greater.
This limitation does not apply to liability that cannot lawfully be limited.
19. Indemnity
You indemnify Lawson Media Pty Ltd and its officers, employees, contractors and agents against any loss, damage, liability, claim, cost or expense arising from:
- your breach of these Terms;
- your misuse of PodFinder;
- your content;
- your infringement of any third-party rights;
- your breach of law.
This indemnity is reduced to the extent the loss was caused or contributed to by our negligence, wilful misconduct or breach of these Terms.
20. Suspension and termination
We may suspend, restrict or terminate your access to PodFinder if we reasonably believe:
- you have breached these Terms;
- your account has been compromised;
- your use creates legal, security, operational or reputational risk;
- we are required to do so by law;
- continuing to provide access is no longer commercially or technically viable.
You may stop using PodFinder at any time.
If account deletion features are available, you may request account deletion in accordance with our Privacy Policy and account settings.
Sections that by their nature should continue after termination will continue, including intellectual property, disclaimers, limitation of liability, indemnity and dispute resolution provisions.
21. App stores and mobile platforms
If you download PodFinder from the Apple App Store, Google Play or another app marketplace, the app store’s terms may also apply.
The app store provider is not responsible for PodFinder, our content, support, claims, maintenance or legal compliance, except to the extent required by its own terms or applicable law.
If there is any inconsistency between these Terms and the applicable app store terms, the app store terms may apply to the extent required by that app store.
22. Third-party services and integrations
PodFinder may integrate with or link to third-party services, including podcast platforms, directories, analytics tools, authentication providers, payment providers, AI technology providers, hosting providers or app stores.
Your use of third-party services may be subject to separate terms and privacy policies.
We are not responsible for third-party services unless required by law.
23. Unfair contract terms
If these Terms are a standard form contract under the Australian Consumer Law, nothing in these Terms is intended to create, rely on or enforce an unfair contract term.
If a provision of these Terms would otherwise be unfair, unlawful or unenforceable, it is to be read down to the minimum extent necessary to avoid that result, or severed if it cannot be read down.
Australian law protects consumers and small businesses from unfair terms in standard form contracts, and penalties may apply for proposing, using or relying on unfair contract terms.
24. Changes to these Terms
We may update these Terms from time to time.
The latest version will be posted on our website with the “Last updated” date.
If we make material changes, we may take reasonable steps to notify you, such as by email, in-app notice or website notice.
By continuing to use PodFinder after changes take effect, you agree to the updated Terms.
25. Governing law
These Terms are governed by the laws of Victoria, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from those courts.
Nothing in this section limits any rights you may have under applicable consumer protection laws in your country or region.
